1. Who provides the Online Services
These Terms govern the Pure Joy Pet Salon website, online booking and waitlist tools, private appointment links, customer report cards, and related customer features (the “Online Services”). The Online Services are provided under the trade name Pure Joy Pet Salon (“Pure Joy,” “we,” “us,” or “our”) from 1490 Broadway Ave, Atwater, CA 95301. Grooming and mobile services also require the applicable grooming agreement and stored-card authorization.
3. Booking requests and availability
Displayed availability is not guaranteed until a booking is successfully confirmed. Pure Joy may decline, modify, or reschedule a request because of staff availability, service qualifications, pet or customer safety, location, travel, weather, equipment, incomplete information, a payment issue, or another operational constraint.
Mobile arrival times are communicated as windows, not exact times. Salon and mobile services may have different policies and fees.
Quotes are based on information known before the appointment. Final service time and price may change because of coat condition, size, behavior, specialty styling, add-ons, or conditions discovered during grooming. A charge not already disclosed or authorized by an effective agreement or policy requires customer approval.
4. Agreements, cards, deposits, and fees
Every grooming booking may require acceptance of the applicable grooming agreement and stored-card authorization. Saving a card does not authorize unspecified charges.
If a deposit is required, the Online Services display the amount before the customer confirms and pays. Cancellation, no-show, drop-off, pickup, day-care, or overnight fees apply only under an effective agreement or policy that identifies the amount and triggering condition.
5. Communications
Customers may receive service-related communications, including booking confirmations, reminders, schedule changes, ready-for-pickup notices, waitlist messages, receipts, private report-card links, and replies to customer messages. SMS and MMS delivery depends on the customer’s carrier and Twilio. Carrier message and data rates may apply.
Optional marketing messages are sent only under a separate consent process. A customer may ask Pure Joy to stop optional marketing without stopping operational messages reasonably necessary for an active request or transaction, subject to applicable law.
6. Private links and customer responsibilities
Some customer features use private links rather than a password-based customer account. You must keep those links confidential and notify Pure Joy if a link is sent to the wrong person or appears compromised. Anyone with a valid private link may be able to view or act on the information authorized by that link.
You must not misuse the Online Services, attempt to access another person’s information, interfere with security or availability, submit unlawful or harmful content, impersonate another person, scrape the service, or use automated tools in a way that burdens the service.
7. Customer-provided information and content
Customers retain their rights in information, messages, notes, and photos they provide. Customers authorize Pure Joy and its service providers to host, copy, transmit, display, and otherwise process that material only as reasonably needed to provide, secure, support, document, and improve the requested services or comply with law.
These Terms do not grant Pure Joy permission to use a customer’s or pet’s photo in public marketing. Public marketing use requires separate permission.
8. Pure Joy content
The Online Services, branding, layout, text, graphics, and software are owned by Pure Joy or its licensors and are protected by applicable law. Customers may use them only for personal interaction with Pure Joy and may not copy, sell, reverse engineer, or commercially exploit them except as law expressly permits.
9. Third-party services and links
The Online Services rely on third parties, including Square for card entry and payments, Twilio for messaging, and Cloudflare for hosting and data infrastructure. Fonts are hosted by Pure Joy, so rendering text does not send a request to a remote font provider. The optional location map contacts Google only after a visitor selects “Load Google Map.” External links, including Square booking or payment pages, Google Maps directions, and Google review pages, are governed by the third party’s own terms and privacy practices.
Pure Joy does not control third-party availability and is not responsible for a third party’s independent acts, except where applicable law provides otherwise.
10. Privacy
Personal information is handled as described in our Privacy Policy. Browser technologies are described in our Cookie and Browser Storage Notice.
11. Service availability and disclaimers
To the fullest extent allowed by law, the Online Services are provided “as is” and “as available.” Pure Joy does not promise that the website, booking feed, messages, private links, integrations, or stored information will always be available, uninterrupted, current, or error-free.
Online information is not veterinary advice and is not a substitute for a veterinarian. Customers remain responsible for seeking appropriate veterinary care and for giving Pure Joy accurate health and behavior information.
Nothing in this section limits a warranty, remedy, or consumer right that cannot lawfully be limited. The applicable grooming agreement, not this digital-services section alone, governs risks specific to hands-on grooming.
12. Limitation of liability
To the fullest extent permitted by law, Pure Joy will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of or inability to use the Online Services. For a claim arising solely from the Online Services, Pure Joy’s aggregate liability will not exceed the amount the customer paid for the transaction giving rise to the claim.
This limitation does not apply where the law does not permit it and does not limit liability for conduct that cannot lawfully be limited.
13. Responsibility for misuse
To the extent permitted by law, a user who intentionally misuses the Online Services, violates another person’s rights, or submits unlawful content is responsible for resulting third-party claims and reasonable costs. This does not require a consumer to indemnify Pure Joy for Pure Joy’s own unlawful conduct.
14. Suspension and ending use
Pure Joy may restrict online access or decline online booking when reasonably needed for safety, fraud prevention, unpaid authorized fees, legal compliance, system protection, or a violation of these Terms. A customer may stop using the Online Services at any time, but stopping use does not cancel an existing appointment or amount properly due.
15. Changes
Pure Joy may update these Terms for operational, legal, or technical reasons. Material changes will be clearly posted and, when appropriate, communicated before they apply. A change that requires new consent will not apply until that consent is collected.
16. Applicable rights and resolving concerns
Customers may first contact Pure Joy at purejoypetsalon@gmail.com or by mail at Pure Joy Pet Salon, 1490 Broadway Ave, Atwater, CA 95301 so the parties can try to resolve a concern informally. Applicable law and non-waivable consumer rights continue to apply.
17. Events beyond reasonable control
To the fullest extent permitted by law, Pure Joy is not responsible for delay or failure caused by events beyond its reasonable control, including severe weather, wildfire, unsafe road conditions, utility or telecommunications outages, government action, labor disruption, or failure of a third-party service provider. Pure Joy may pause, relocate, or reschedule affected Online Services or appointments as reasonably necessary. This section does not limit a right or remedy that cannot lawfully be limited or excuse an obligation that applicable law requires Pure Joy to perform.
18. Agreement hierarchy and entire agreement
Together with the applicable grooming agreement, stored-card authorization, Privacy Policy, and booking-specific terms the customer expressly accepts, these Terms state the agreement concerning the Online Services. If those documents conflict, the more specific document controls its subject: the grooming agreement controls hands-on grooming, the stored-card authorization controls card storage and permitted charges, and the Privacy Policy describes personal-information handling.
These documents do not replace a separate written agreement signed by Pure Joy and the customer unless that agreement expressly says they do. Subject to that rule, the identified documents supersede earlier statements about the same Online Services. Nothing in this section limits a right or remedy that cannot lawfully be limited.
19. General terms
If part of these Terms is unenforceable, it will be limited only as much as necessary and the remainder will continue. Failure to enforce a term once is not a waiver. A customer may not transfer an appointment or private access link in a way that misrepresents identity or authority.
